Terms and Conditions

This Agreement applies to the rental items, inflatables, tents, tables, chairs, linens, concession equipment, catering, snack bars, dessert tables, delivery, setup, and related services included in the Customer's order. Provisions apply only to the products and services actually ordered. The order confirmation, invoice, and electronically captured customer and event information are incorporated into this Agreement by reference.

1. Agreement and Customer Responsibility

“Company” means Pao & Andy Party Rentals & Catering. “Customer” or “Lessee” means the person accepting this Agreement and any person or organization on whose behalf the order is placed. “Equipment” means the rental items supplied by the Company.

The Customer represents that they are at least 18 years old, have authority to accept this Agreement, and accept responsibility for their guests, invitees, event participants, and anyone using or handling the Equipment.

2. Payment, Deposit and Catering Changes

All prices, deposits, taxes, delivery charges, and balances are shown in the order or invoice.

The required deposit is non-refundable. The remaining balance is due 24 hours before the Event or at the time of setup, unless the Company agrees otherwise.

Late or incomplete payment may result in an additional fee, delayed service, or the Company declining delivery or setup. Customers should contact the Company promptly if payment arrangements need to be discussed.

Any changes to catering selections, quantities, serving arrangements, or other requested catering modifications must be communicated at least 72 hours before the Event and remain subject to availability and any applicable price adjustment.

3. Delivery, Access, Setup and Pickup

Delivery will be made to the address specified by the Customer. The Customer grants the Company and its representatives permission to enter the property at reasonable times for delivery, setup, inspection, service, and pickup of the Equipment.

Delivery and pickup times are approximate and may be affected by traffic, weather, prior events, site access, or other conditions.

The Customer must provide a safe, clear, accessible, and suitable setup area and disclose known hazards, restrictions, underground utilities, irrigation systems, septic systems, overhead obstructions, or other conditions that could affect safe installation.

Equipment may not be moved, altered, disconnected, deflated, re-anchored, or relocated after setup without the Company’s permission.

4. Equipment Care, Cleaning and Damage

The Customer agrees to exercise reasonable care while Equipment is in their possession and to return it in substantially the same condition in which it was delivered, ordinary wear and tear excepted.

Excessive cleaning may result in an additional cleaning fee. The Customer may also be responsible for repair or replacement charges for damaged, lost, stolen, or missing Equipment beyond ordinary wear and tear.

The Customer must stop use immediately and contact the Company if Equipment becomes unsafe, damaged, unstable, partially deflated, or appears to malfunction.

5. Utilities and Site Requirements

The Customer must provide safe and adequate electrical service when required for blowers, concession machines, or other powered Equipment. The Customer must also provide an appropriate water source and hose when required for water attractions or catering services.

The Company is not responsible for interruptions caused by inadequate electricity, water pressure, utilities, venue restrictions, or conditions outside the Company’s control.

6. Weather and Unsafe Conditions

The Company may delay, suspend, refuse, or discontinue setup or use of Equipment when weather or site conditions are unsafe, including high winds, lightning, storms, flooding, heavy rain, unstable ground, or other hazards.

The Customer must immediately stop use and have all participants exit any inflatable or outdoor Equipment when unsafe weather develops or when instructed by the Company.

If weather affects the Event, the Customer should contact the Company to discuss whether a rain check, weather credit, rescheduling option, or other accommodation may be available. Any such option will depend on the circumstances of the Event and is not guaranteed.

7. Supervision and General Safety

The Customer agrees to supervise the Equipment and its use at all times. A responsible, sober adult must be present whenever an inflatable, interactive amusement game, concession machine, or other Equipment is being used.

All posted manufacturer rules, capacity limits, height limits, weight limits, and Company instructions must be followed. No person under the influence of alcohol, drugs, or any impairing substance may operate, supervise, or use Equipment.

No smoking, open flame, fireworks, grills, heaters, or combustible materials are permitted near Equipment unless specifically approved and safely positioned.

8. Inflatable and Interactive Equipment Safety Rules

1) Follow all safety rules and operating instructions posted on the inflatable or provided by the Company.

2) A responsible adult operator must be on duty at all times and should use a whistle or other audible signal when necessary.

3) In high winds or storms, all participants must exit immediately. When safe, unplug the unit and allow it to deflate.

4) Remove shoes, eyeglasses, jewelry, sharp objects, and pointed objects before entering.

5) No Silly String may come into contact with the inside or outside of the unit.

6) No food, drinks, or chewing gum are allowed inside inflatable units.

7) No flips, somersaults, wrestling, piling on, rough play, or horseplay.

8) Do not bounce against the sides, corner posts, or entrance area.

9) Do not climb on side walls or safety netting.

10) Keep a safe distance between participants.

11) Do not sit or jump on the entrance ramp.

12) Do not jump from the top or side of a slide.

13) Only participants of similar size and ability may use the unit together.

14) Follow all posted maximum-rider and weight limits.

15) Do not allow the inflatable to rub against buildings, fences, trees, pavement, or other surfaces.

16) Do not move the inflatable from the location where it was installed.

17) Pregnant individuals, infants, and persons with head, neck, back, heart, mobility, or other conditions that may increase the risk of injury should not use the unit.

18) Water may be used only with units specifically manufactured and approved for wet use.

19) Splash pools must be drained when left unattended unless the area is securely fenced and locked.

20) Dunk tanks and splash pools must use potable water and should be drained and refreshed every four hours of use. Any dunk-tank participant must be at least 18 years old.

21) If a unit begins to deflate, all riders must exit immediately. Check the power connection and circuit breaker, confirm the blower is running, clear any blower-intake obstruction, and verify that all inflation tubes are secure.

22) The unit must be fully reinflated before use resumes.

23) If the problem cannot be corrected safely, discontinue use and call the Company at (707)359-9929. Do not attempt repairs or continue operation.

9. Tents, Tables, Chairs, Linens and Other Rentals

Tents and canopies must remain anchored as installed and may not be moved, altered, or decorated with nails or staples. Open flames and unsafe heaters are not permitted near tents, canopies, linens, or other rental Equipment.

Guests may not climb, hang from, or place excessive weight on tents, tables, chairs, concession equipment, or other rental items. Linens should be protected from candles, wax, grease, ink, markers, mildew, and other substances likely to cause permanent staining or damage.

10. Catering and Food-Service Terms

Catering services will be provided according to the menu, package, quantities, serving arrangements, and other details shown in the order. Requested changes remain subject to availability and any applicable price adjustment.

The Customer must provide accurate allergy and dietary information before the Event. The Company cannot guarantee an allergen-free environment or prevent cross-contact unless expressly agreed in writing.

The Customer is responsible for providing safe access, adequate parking, a sanitary service area, and any utilities, tables, shelter, permits, or venue approvals not specifically included in the order.

The Company may stop or refuse food service when conditions are unsafe, unsanitary, unlawful, or materially different from those disclosed when the order was accepted.

11. Assumption of Risk

The Customer understands and acknowledges that the use of interactive amusement games, inflatables, water attractions, concession equipment, rental equipment, and participation in Event activities involves known and unanticipated risks. These risks include, but are not limited to, falling, slipping, tripping, tipping, crashing, colliding, equipment movement, electrical hazards, burns, choking, allergic reactions, foodborne illness, property damage, serious bodily injury, illness, emotional distress, paralysis, and death.

The Customer voluntarily assumes all risks arising from or related to the Event, the Equipment, catering services, and the conduct of the Customer, guests, invitees, participants, property owners, and third parties, except to the extent a risk cannot lawfully be waived.

12. Release, Indemnification and Hold Harmless

To the fullest extent permitted by law, the Customer voluntarily releases, indemnifies, defends, and holds harmless Pao & Andy Party Rentals & Catering and its owners, employees, contractors, agents, and representatives from claims, demands, actions, losses, damages, injuries, liabilities, judgments, costs, and expenses arising out of or relating to the Event, the Customer’s order, possession or use of the Equipment, catering services, site conditions, or acts or omissions of the Customer, guests, invitees, participants, property owners, or third parties.

This release includes claims allegedly arising from ordinary negligent acts or omissions of the Company to the extent such claims may lawfully be released. It does not apply to liability that cannot be waived under applicable law. The Customer agrees to reimburse reasonable attorney fees and costs incurred by the Company in defending a covered claim.

13. Insurance

The Customer acknowledges that they have adequate homeowners, renters, commercial, event, or other liability insurance to cover bodily injury and property damage that may occur in connection with the Event, or the Customer agrees to personally bear such costs.

14. Governing Law and Severability

This Agreement is governed by the laws of the State of California. Any action arising from this Agreement shall be brought in a court of competent jurisdiction in California, unless applicable law requires otherwise.

If any portion of this Agreement is found void or unenforceable, that portion shall be limited or removed only to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement and Electronic Acceptance

This Agreement, together with the order, invoice, posted safety rules, and written Company policies incorporated into the checkout process, constitutes the entire agreement between the parties and supersedes prior oral or written discussions concerning the order. Any modification must be confirmed in writing by the Company.

Electronic acceptance and signature have the same force and effect as an original handwritten signature. By signing or accepting electronically, the Customer acknowledges sufficient opportunity to read this Agreement, understands its contents, accepts it freely and without duress, and agrees to be bound by its terms.

16. Photo and Marketing Permission

Unless the Customer opts out in writing before the Event, the Customer permits the Company to photograph the rental setup, food display, and Equipment for portfolio and marketing purposes, provided the Company does not intentionally identify minor children or disclose private customer information without additional permission.
